PIP FILMS STANDARD BOOKING TERMS
These Standard Booking Terms apply to all services provided by PIP PERFORMANCE IN PICTURE LTD, trading as PIP FILMS. By confirming a booking with PIP FILMS, the Client agrees to these Standard Booking Terms.
1. BOOKING & SERVICES
The scope of each project will be set out in the agreed quotation, proposal or email correspondence between PIP FILMS and the Client.
Any changes to the agreed scope of work will be subject to additional fees and will be agreed with the Client in writing before the additional work is undertaken.
2. FEES & PAYMENT
Fees are as set out in the agreed quotation or proposal.
PIP FILMS will invoice in stages, with:

50% invoiced at an agreed midpoint of the Project, for example following filming.

50% invoiced once the final deliverables have been supplied.
For smaller or otherwise suitable projects, PIP FILMS may instead issue a single invoice.
Invoices are payable within 15 days of issue, unless otherwise agreed in writing.
Late payments may incur statutory interest and recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
3. CANCELLATION & POSTPONEMENT
If the Client cancels a project before work has commenced, no fee will be payable other than any non-recoverable expenses already incurred or committed by PIP FILMS.
If a planned filming date is cancelled by the Client less than 7 days before the scheduled filming date, PIP FILMS will invoice for:

All work completed up to the point of cancellation or postponement, including preparation and filming.

Any other non-recoverable expenses incurred in connection with the Project.
If a planned filming date is cancelled by the Client less than 7 days before the scheduled filming date, PIP FILMS will invoice for:

Any freelance crew or other suppliers already booked or committed.

A £400 cancellation fee.
Where a filming date needs to be postponed, PIP FILMS will work with the Client to agree a suitable alternative date, subject to availability. If the postponement results in additional costs these will be charged to the Client.
4. CLIENT RESPONSIBILITIES
The Client is responsible for:

Providing clear instructions and approvals within a reasonable timeframe, normally within 7 days of an edit being delivered for review.

Obtaining any necessary permissions and releases for locations and contributors.

Providing access to locations, people and materials required for the Project.

Informing PIP FILMS of any relevant restrictions, requirements or sensitivities relating to the Project.
PIP FILMS will not be responsible for delays or additional costs caused by the Client's failure to meet these responsibilities.
5. REVISIONS & DELIVERY
Unless otherwise agreed, the agreed fee includes three rounds of revisions. A revision round consists of one consolidated set of feedback from the Client. Deliverables will be deemed approved if no material issues are raised within 7 days of delivery.
Additional revisions, substantial changes to the agreed brief, or requests made after approval of the final edit will be charged at PIP FILMS' applicable day or hourly rate.
Once the final deliverables have been supplied, PIP FILMS will issue any outstanding final invoice, which will be payable in accordance with the payment terms above.
6. COPYRIGHT & USAGE
Upon full payment, the Client is granted a perpetual licence to use the final video(s) for their own purposes. PIP FILMS retains copyright of the original footage and finished video(s), subject to the licence granted to the Client under these terms.
PIP FILMS retains the right to use the final video(s), in whole or in part, solely for self-promotional purposes, including portfolio and showreel use and promotion on the PIP FILMS website and social media platforms, provided that the video(s) have been publicly published or shared by the Client.
Where a video is created for internal use only and has not been made public by the Client, PIP FILMS will not use the video for self-promotional purposes without the Client's prior written consent.
PIP FILMS will not sell or license the video(s) to third parties without the Client’s prior written permission.
7. ERRORS, REMEDIES & LIABILITY
PIP FILMS will take reasonable care to deliver the Project in accordance with the agreed brief.
If PIP FILMS makes an error or the final deliverables do not substantially meet the agreed brief, PIP FILMS will be given an opportunity to correct or re-edit the work where this is possible.
PIP FILMS will not be liable for indirect or consequential losses, including loss of profit, revenue, funding or reputation, or for issues arising from circumstances or third parties outside PIP FILMS' reasonable control.
To the extent permitted by law, PIP PERFORMANCE IN PICTURE LTD's total liability in connection with a Project will be limited to the total fees paid by the Client for that Project.
Nothing in these terms limits or excludes liability that cannot legally be limited or excluded.
8. FORCE MAJEURE
Neither party will be liable for failure or delay in performing their obligations where this is caused by circumstances beyond their control, including serious illness, accident, venue restrictions, or other circumstances which could not have been anticipated or prevented when the work was agreed upon.
9. ACCEPTANCE OF TERMS
These Standard Booking Terms apply to all bookings made with PIP FILMS unless alternative terms have been agreed in writing.
A Client's confirmation to proceed with a quotation, proposal or booking from PIP FILMS constitutes acceptance of these Standard Booking Terms.
Where the specific quotation, proposal or written project confirmation conflicts with these Standard Booking Terms, the specific agreed project terms will take precedence.
10. GOVERNING LAW
These Standard Booking Terms and any agreement between PIP FILMS and the Client shall be governed by the laws of England and Wales.
